Today according to the Constitution, President Trump nominated Amy Coney Barrett to be a Justice on the Supreme Court to fill the vacancy left by the death of Justice Ginsburg. Judge Barrett is very well qualified for this appointment. She has served on the Seventh Circuit Court of Appeals for the past three years and previous to that was a professor of law at Notre Dame University for seven years. She has continued to teach seminars while sitting on the Seventh Circuit. Her legal philosophy is grounded in constitutional law, originalism, and statutory interpretation. Judge Barrett understands that it is the responsibility of a judge to interpret the “spirit and letter” of the written law that exists against the “yardstick” of our Constitution and not to legislate, or create law, from the bench.
Article VI of our Constitution establishes it as the supreme law of the land and requires that our elected representatives serve in office bound by Oath or Affirmation, to support the Constitution.
“I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion, and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
It is also important to note that Article VI. Clause 3. along with the oath establishes that “no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.”
During Judge Barrett’s confirmation hearings for her appointment to the Seventh Circuit, the Left made much of her being a devout Roman Catholic. This is a clear violation of the religious test clause of our Constitution. Her religious views are not a matter for consideration by the Senate. They are only to be concerned with her willingness to fulfill the oath, her understanding of the Constitution, and her ability to faithfully discharge her duties as a Supreme Court Justice.
There is often talk during confirmation hearings of “litmus tests.” If any litmus test should be applied to her selection, it should be the litmus test of the Founding Fathers. A litmus test to determine if she would support “Constitutional Supremacy” over “Judicial Supremacy.” A litmus test to determine if she would support “Constitutional Supremacy” over “Presidential or Congressional Ideology.” A litmus test to ensure against legislating through activism from the Bench. A litmus test which would determine that she will only consider the constitutionality of the matter before her according to the spirit and letter of our Constitution as intended by the Founding Fathers. It is only by this that We the People can preserve our Constitutional Republic and “secure the Blessings of Liberty to ourselves and our Posterity.”
